سامسونج وآبل تعودان للقضاء وتعويضات بقيمة 400 مليون دولار
عادت المعركة القضائية بين آبل وسامسونج حول مفهوم الزوايا المنحنية في تصميم الهواتف الذكية وغيرها للواجهة من خلال طلب القاضي إعادة تقييم القضية التي توقفت عند مبلغ 400 مليون دولار.
كانت قد تمت تسوية القضية عام 2012 عندما طلبت المحكمة من سامسونج أن تدفع تعويضات بمقدار مليار دولار، لكن عدة استئنافات جرت على القضية لاحقاً تم بموجبها تخفيض التعويضات إلى 400 مليون دولار.
وقررت القاضية Lucy Koh أنه يجب على الشركتين إعادة المحاكمة وإعادة تقييم القضية والنظر في مبلغ التعويض بعد الاستئناف الجديد الذي تقدمت به سامسونج ونجحت في اقناع القاضية.
ومازال هناك خلاف حول آلية تقدير التعويضات المطلوبة من سامسونج لانتهاك براءات اختراع مملوكة لآبل منها يتعلق بتصميم الهواتف أيضاً. ويدور الخلاف حول إن كانت قيمة التعويضات ستكون بنسبة من الأرباح الإجمالية التي حققتها سامسونج من مبيعات الهواتف التي تنتهك براءات الاختراع؟ أم يتم الاعتماد على معيار آخر؟
